Terms of Service

1. About these terms

SpeakKey (the website speakkey.com, the SpeakKey apps for Android and iPhone, and the SpeakKey USB Stick) is provided by Waive Technology Pty Ltd (ABN 24 698 686 510), Australia (“SpeakKey”, “we”, “us”). By creating an account or using SpeakKey you agree to these terms and to our Privacy Policy. If you do not agree, please do not use SpeakKey.

2. The service

SpeakKey turns your recordings, photos and PDF forms into documents using AI, and can type them onto a computer through the SpeakKey USB Stick (or, on Android, over Bluetooth). It also includes Live Type, templates, macros, the Template Builder assistant and a public template gallery. Features that need AI processing send your content to third-party AI service providers, as described in the Privacy Policy; in the apps you are asked for permission first.

3. Your account

• You must be at least 18 years old to use SpeakKey.
• You must give accurate information, keep your sign-in details secure, and you are responsible for activity on your account.
• New accounts include 7 days of full access. After that, processing new recordings, photos and forms requires a paid subscription.

4. Paid plans

• A paid plan renews automatically each billing period until it is cancelled, and is billed by our payment provider.
• You can cancel at any time; access continues until the end of the period you have paid for.
• We may change prices with reasonable notice before your next renewal.
• Refunds are considered case by case; email support@speakkey.com. Nothing in these terms limits your rights under the Australian Consumer Law.

5. Your content

• You own the recordings, photos, forms and other content you provide and the documents created from them.
• You give us permission to store and process your content, including through our third-party AI service providers, only to provide SpeakKey to you.
• You must have the right to record, upload and process your content. If it contains information about other people — including health information about patients or clients — you are responsible for having their consent or another legal basis, and for meeting your own professional and record-keeping obligations.

6. AI-generated output

• Transcriptions, documents, filled forms and Template Builder replies are generated by AI and can contain errors or omissions.
• You must review and correct any output before you rely on it or share it.
• We do not guarantee that output is accurate, complete or suitable for a particular purpose.

7. Medical and professional use

• SpeakKey is a dictation and document-formatting tool. It is not a medical device and does not diagnose, treat, cure or prevent any medical condition.
• Nothing SpeakKey produces is medical, legal or other professional advice. Templates such as “Medical Consultation” only format what you dictate.
• If you use SpeakKey in clinical or other professional work, you remain responsible for checking every document and for the decisions you make. Always seek the advice of a qualified health professional about a medical condition.
• SpeakKey is not a records system: documents can be deleted under your retention settings, so keep final documents in your own records system.

8. Acceptable use

You agree not to:

• use SpeakKey for anything unlawful, or to record people where that is not allowed;
• try to gain unauthorized access to SpeakKey or to other users’ accounts or content;
• interfere with or disrupt SpeakKey, or try to misuse its AI features (for example, to produce harmful content);
• reverse engineer SpeakKey, or access it with automated tools beyond normal use;
• resell or redistribute SpeakKey without our permission.

9. Template gallery rules

The template gallery lets you publish templates for every SpeakKey user to see and copy. Before you first publish, you agree to these rules.

What you may not publish. A gallery template (its name, description, instructions, form and display name) must not:

• be illegal, or promote illegal activity;
• be hateful, harassing, threatening, violent, sexually explicit or otherwise offensive;
• be spam, advertising, or misleading about what the template does;
• contain personal information about anyone, including health information, contact details or fixed form values that identify a person;
• infringe anyone else’s copyright, trade marks or other rights;
• impersonate a person or organization; or
• contain instructions meant to make the AI ignore its safeguards or misuse other users’ content.

Licence. You keep ownership of what you publish. By publishing, you give us and every SpeakKey user a worldwide, non-exclusive, royalty-free licence to view, copy, adapt and use the template within SpeakKey. You can unpublish a template at any time; copies other users have already made stay in their accounts. You confirm you have the right to publish the template.

Checks, reports and hiding. Templates may be checked automatically when they are published. Any user can report a template (Report) and, in the SpeakKey apps, stop seeing an author’s templates (Hide templates from this author). We review reports and act on them promptly.

Removal. We may remove any gallery template, and suspend or close the account that published it, if we believe it breaks these rules or the law.

10. SpeakKey USB Stick

The SpeakKey USB Stick is sold separately on our store page; it is not included with a SpeakKey account. For returns, faults or warranty questions, email support@speakkey.com with your order details. Your rights under the Australian Consumer Law apply to every purchase.

11. Service availability

• We aim to keep SpeakKey available but do not guarantee uninterrupted service.
• We may carry out maintenance or updates that affect availability for a time.
• We may change, suspend or stop features with reasonable notice.

12. Limitation of liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of SpeakKey, and our total liability is limited to the amount you paid us for SpeakKey in the 12 months before the claim.

13. Ending your account

• You can delete your account at any time: in the Android or iPhone app (Account → Delete account) or on the web (Account Settings → Security → Delete account). speakkey.com/delete-account explains what is removed and kept.
• We may suspend or close your account if you break these terms.
• When your account ends, your access ends and your data is deleted as described in the Privacy Policy.

14. Changes to these terms

We may update these terms. We will tell you about material changes through SpeakKey or by email before they take effect. If you keep using SpeakKey after that, the updated terms apply.

15. Governing law

These terms are governed by the laws of Queensland, Australia, and the courts there have non-exclusive jurisdiction.
